Trace Federal Custody Releases

To find someone released from federal or immigration custody after a Hardy County case, first locate a documented federal writ, warrant, detainer, or receiving agency. No ICE detention center or federal jail is located in Hardy County. A person who disappears from the regional-jail search may have transferred to ICE or the U.S. Marshals Service rather than returned to the community. Federal and immigration systems answer different questions, so use the named custodian and read absence from any locator with care.

Hardy Federal Release Routes

ICE handles civil immigration detention. The U.S. Marshals Service handles federal pretrial, transport, and court-directed custody. BOP holds sentenced federal prisoners. These agencies are separate from Hardy County, PHRJCF, and WVDCR even when one custodian transfers a person to another.

A PHRJCF movement entry may say that another sovereign received the person. That is not community release. Confirm the destination through the receiving system, federal docket, counsel, or agency record. Search ICE or USMS only when a case document supplies a factual reason.

Search ICE Custody Status

The official ICE Online Detainee Locator System offers two routes. An A-number search uses the nine-digit immigration identifier, with zero padding when needed, plus country of birth. A biographical search uses exact first and last name, country of birth, and an optional date of birth.

  1. Confirm ICE custody or a detainer is documented.
  2. Use the A-number route when the identifier is known.
  3. Otherwise enter exact biographical information.
  4. Compare the returned identity and custody information.
  5. Use the responsible ERO office or information line when no clear result appears.

ICE public resources can include current detainees and some people released from ICE custody within the past 60 days. That short history is distinctive, but it is not a permanent Hardy release archive. A negative result outside the window proves little.

Do not infer status: A name, birthplace, or missing locator result cannot establish immigration status or release.

ICE Records and Contact

No official ICE detention facility exists in Hardy County based on the researched sources. Use the national locator and the responsible Enforcement and Removal Operations field office shown by the case. The detention information line can help with basic case information and routing.

The official ICE detention information page is the verified channel. For a record of an old ICE release, use the agency's current records process and describe the person, A-number, dates, and requested custody event. Do not invent a local field-office address when the research does not identify one.

USMS Hardy Custody Records

The U.S. Marshals Service has no public prisoner locator comparable to BOP. A federal pretrial detainee may be housed under contract at a local or regional site and later move without appearing in BOP. The federal docket is the most useful public route for the court event, while counsel or the clerk can clarify case posture.

The USMS Northern District of West Virginia page identifies the district serving the area. A narrow USMS FOIA request may seek an existing prisoner-custody or movement record, subject to federal disclosure restrictions. Ask for the dated transfer or release entry, not broad private case material.

If PHRJCF releases a person to the Marshals, regional custody ends but federal custody starts. Keep both events in the record chain.

Federal Transfer Versus Release

A detainer is another authority's request to hold or receive a person. It can delay a court-authorized release or change the destination at physical exit. The local court order may resolve the Hardy charge while the detainer keeps the person from returning to the community.

Read verbs exactly. Released to ICE, remanded to USMS, transferred to another facility, released on federal conditions, and discharged from immigration custody are different outcomes. The first three may continue physical custody. A locator absence cannot select among them.

Detainer
A request from another authority concerning custody or pickup.
Remand
A court order placing or keeping the person in custody.
ERO
ICE Enforcement and Removal Operations, which manages detention cases.
Community release
Physical exit without an immediate transfer to another jailer.

Hardy Release Record Chain

Begin with the PHRJCF final movement entry if the person left the regional jail. It can name a receiving agency. Obtain the Hardy court order to understand the state case. Then use the federal docket or immigration channel for the next custody phase.

VINELink may send a regional transfer event, but it does not replace the receiving agency's record. WVDCR notes that transfer notice can wait until arrival at the new facility. That built-in gap makes a brief period of uncertainty possible.

  1. Save the WVDCR OID and Hardy case number.
  2. Request the PHRJCF destination or movement field.
  3. Read the court order for warrants and holds.
  4. Confirm the named federal custodian.
  5. Obtain its release record before stating community return.

Federal Court Release Proof

A federal docket can show an initial appearance, detention order, release order, judgment, sentence, and supervised-release term. It establishes federal legal authority, not always the exact moment a holding facility completed release. Pair it with the custodian's record.

Federal supervised release is court supervision after imprisonment and differs from West Virginia parole. A person can be out of BOP custody while subject to it. Immigration proceedings are also separate from the federal criminal sentence. Avoid merging these distinct legal systems into one “federal release” label.

Old Federal Release Records

ICE's public released-person window is short. USMS lacks a public name locator. BOP has broader historical locator coverage for sentenced federal prisoners since 1982, but it does not cover every Marshals or immigration custody period. Older research therefore depends more heavily on agency records and the federal docket.

Give the request the exact identifier, including A-number or federal register number when known. State the facility or receiving agency, dates, and the existing record sought. Ask for segregable nonexempt portions if federal law protects part.

Federal History Limits

An old negative ICE search is weak because the public released-person coverage can end after 60 days. Save the date of each search and do not present a current locator as an all-time history. Counsel, the immigration case record, and an agency response may be needed to rebuild an older sequence.

For federal pretrial custody, distinguish the court's release order from the Marshals' completion of custody. A pending warrant, another sovereign's detainer, or transport can affect the physical outcome. Ask the federal clerk for the filed order and USMS for the narrow event it created.

When BOP later appears, use the register number to connect the sentenced-custody phase. Its locator is stronger for former federal prisoners than the ICE or USMS public options, but it cannot settle custody before designation or after transfer to another authority.

Choose the Correct Custodian

Use WVDCR for a Hardy regional-jail or state-prison case. Use BOP for a sentenced federal prisoner. Use ICE for documented civil immigration detention. Use the federal docket and USMS route for federal pretrial custody. A failed search in one system is not permission to make assumptions about another.

The Hardy County released inmate search lays out the full custody ladder. The BOP release page covers the sentenced federal path in more depth. Note: No federal or immigration detention facility operates in Hardy County according to the researched official sources.

Federal Release Record Fields

Build the federal timeline from identifiers and dated events. Useful fields include full name, A-number or register number, Hardy case number, federal case number, sending custodian, receiving custodian, movement date, release date, and the order authorizing the action. Not every public response will include every field.

Ask each agency only for the phase it controls. PHRJCF can address its final movement. ICE can address civil immigration custody. USMS can address its prisoner movement, subject to disclosure limits. BOP can address sentenced federal prison custody. The federal court can supply its public order.

A transfer can make one locator go blank before another system is easy to search. Preserve the destination from the movement record and allow for data lag. Until the receiving custodian or a release record confirms the next event, describe the status as unresolved rather than released to the community.

Federal Custody Status Terms

Use “released from ICE custody” only when an ICE record supports it. Use “transferred to ICE” when PHRJCF or USMS names ICE as the receiver. A federal release order may permit release under conditions, but a detainer can change the physical destination. “Not located” is merely a search outcome. It is not proof of release, removal, immigration status, or freedom from another custodian.

Keep civil immigration detention separate from a criminal sentence. The legal records, agencies, identifiers, and public search limits are different even when one person moves between them.
